Who is responsible for Belmont Trust?

The City of Belmont owns the land, but Trustees were appointed to manage how the land can be used, under the Declaration of the Trust.

The Trustees

The Trustees appointed to manage the land are the current and successive Elected Members of the City of Belmont Council.

The City of Belmont

The City of Belmont support Belmont Trust in fulfilling its responsibilities relevant to the Declaration of Trust.

Independent Advisory Trustee

In 2006, the Council resolved to appoint an independent trustee. An Advisory Trustee, Mr Malcolm Lee QC, was appointed by the Council to advise, as required, the members of Council in their capacity as Trustees and assist as necessary in any conflict of interest that may arise. Mr Lee is a retired Federal Court Judge, and his practice in WA extended into the area of trusts, and the equitable jurisdiction of the Courts.

The Attorney General of Western Australia

The Attorney General of Western Australia has a special role as protector of all charitable trusts, under the Charitable Trust Acts 1962. Any changes required to Declaration of Trust to accommodate the recommendation of the Community Panel will require the endorsement of the Attorney General.

The current Attorney General for Western Australia is John Quigley.

The Supreme Court

The Supreme Court of Western Australia has the ultimate power in deciding whether any changes can be made to a trust deed or trust scheme. Under the Charitable Trust Act 1962 the Supreme Court would make a determination to enable a change to the trust scheme if that was required to accommodate the recommendation of the community panel.
